Terms & Conditions

A legal disclaimer

1. Definitions

 

“The Company” refers to the landscaping business providing the services.

 

“The Client” refers to the customer receiving the goods or services.

 

“The Works” refers to all services, labour, and materials supplied by the Company as detailed in the quotation or agreement.

2. Quotations & Acceptance

 

2.1 All quotations are valid for 30 days unless stated otherwise.

2.2 Acceptance of a quotation, verbally or in writing, forms a binding contract.

2.3 Any additional work requested that is not included within the quotation will be chargeable and agreed prior to commencement.

 

3. Payment Terms

 

3.1 A deposit may be required before work commences.

3.2 Payments are due as follows unless otherwise agreed in writing:

 

Materials payment upfront if required.

 

Staged payments for longer projects.

 

Final balance due on completion of the works.

3.3 Late payments may incur interest charged at 4% above the Bank of England base rate until settled.

3.4 The Company reserves the right to suspend work if payments are not made as agreed.

4. Cancellations

 

4.1 Cancellation must be provided in writing.

4.2 Deposits are non-refundable once materials have been ordered.

4.3 The Company may charge for any costs already incurred, including labour and materials.

5. Scheduling & Delays

 

5.1 Start dates are estimated and may be subject to change due to weather, supplier delays, or unforeseen circumstances.

5.2 The Company will not be liable for delays outside its control but will communicate changes promptly.

6. Client Responsibilities

 

The Client agrees to:

6.1 Provide clear access to the site for workers, vehicles, and deliveries.

6.2 Ensure pets, children, and personal belongings are kept clear of working areas.

6.3 Obtain any planning permission, building control approval or neighbour agreements, unless otherwise agreed.

6.4 Ensure all animal faeces are removed from lawns, paths, and working areas before work commences each day. Failure to do so may result in delays or an additional cleaning charge.

7. The Works

 

7.1 All work will be carried out with reasonable skill, care, and in accordance with industry standards.

7.2 Materials may vary slightly in colour, shade, or texture due to natural variations.

7.3 The Company may use alternative materials of equal quality if original items become unavailable.

7.4 During construction, the site may be uneven or hazardous. The Client enters at their own risk.

8. Waste Removal

 

8.1 Waste removal will be included only where stated in the quotation.

8.2 Additional waste removal requested by the Client will be chargeable.

9. Utilities & Underground Services

 

9.1 The Client must inform the Company of any known underground services (pipes, cables, drains).

9.2 The Company will not be liable for damage to unknown or unmarked services.

9.3 Any repair costs for unknown services will be the Client’s responsibility.

10. Weather Protection & Aftercare

 

10.1 Fresh turf, plants, render, concrete, and similar materials require proper aftercare by the Client once installed.

10.2 The Company is not responsible for damage caused by weather, failure to water or maintain, or misuse after completion.

11. Guarantees & Defects

 

11.1 Hard landscaping works are guaranteed for 12 months from completion against workmanship defects.

11.2 Natural materials such as timber may shrink, split, or weather naturally; this is not considered a defect.

11.3 Plants, turf, and living materials are not guaranteed once handed over, unless a maintenance plan is included.

11.4 Any concerns must be reported within 7 days of discovery.

12. Garden Rooms & Structures (if applicable)

 

12.1 Garden rooms are constructed according to specification and Building Regulations exemptions unless otherwise agreed.

12.2 Structural warranties apply only to materials and construction, not to client misuse, damp caused by lack of ventilation, or modifications carried out by others.

12.3 Electrical work will be carried out by a qualified electrician and certificated separately.

13. Ownership of Materials

 

13.1 Materials remain the property of the Company until full payment has been received.

13.2 The Company may remove unpaid-for materials if necessary, without liability for damage resulting from their removal.

14. Liability

 

14.1 The Company carries full public liability insurance.

14.2 The Company is not liable for:

 

Indirect or consequential losses.

 

Delays caused by suppliers or weather.

 

Damage resulting from pre-existing site conditions.

​

15. Complaints

 

15.1 All complaints must be made in writing.

15.2 The Company will investigate and seek to resolve issues as quickly as possible.

​

16. Governing Law

 

16.1 These terms are governed by UK law.

16.2 Any disputes shall be handled under UK jurisdiction.
